Child Rearing Costs Acknowledged by Court are Often a Fraction of the Claimed Amount: Data

SEOUL, April 6 (Korea Bizwire)In many cases, the value of child-rearing costs acknowledged by courts was found to be less than half of the amount claimed by parents who filed suits to request payment of child support, data released by a provider of free legal consultation services showed Tuesday.

The Korea Legal Aid Center for Family Relations analyzed 100 cases of ‘litigation aids’ for child-rearing expenses. The analysis showed that the value of monthly child-rearing costs acknowledged by the court ranged between 300,000 won (US$246) and 1.2 million won.

Litigation aid refers to the system in which the state supports litigation expenses for those who are economically vulnerable.

In the past, there were 10 cases of child-rearing cost litigations, in which two cases were rejected by the court.

In five out of the remaining eight cases, the child-rearing cost acknowledged by the court was less than half of the claimed amount.

“In the past, there were many cases where child-rearing expenses were cut by the court based on the judgment that it could lead to an excessively severe result for parents without custody,” the center said.

“However, this attitude of the court represents excessive consideration of the economic condition of noncustodial parents, thereby resulting in a decline in trust of the court system.”

In 60 cases of securing a title of execution for the implementation of child support payments, the value of unpaid child-rearing costs ranged between 10 million won and 30 million won for 36.7 percent or 22 cases, followed by 18.3 percent or 11 cases with a range between 30 million won and 50 million won.
